Terms of Use
These terms are an agreement between you and Northsight Technologies Inc. ("Northsight", "we", "us") for the Tug Out game ("the Game"). By downloading or playing the Game you agree to them. If you do not agree, please don't use the Game. Our Privacy Policy explains how information is handled.
1. Who can play
The Game is intended for players aged 13 and over. If you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for personal, non-commercial use. You may not copy, modify, reverse engineer, resell or distribute the Game, use cheats or automation that interferes with it, or use it unlawfully. All rights in the Game — including its code, levels, Tuglings, pictures, sounds and names — belong to Northsight or our licensors.
3. Coins and rewards
- Coins, hints, boosters and other in-game items are a limited licence to use a feature of the Game. They have no monetary value, cannot be exchanged for real money, and are not refundable except where the law requires.
- The Game currently offers no in-app purchases. If purchases or a subscription are added later, they will be made through the Apple App Store or Google Play, subject to their terms and refund policies, and these terms will be updated before they are offered.
- Progress and unused in-game items are stored on your device and may be lost if you delete the Game or change devices.
4. Ads
The Game shows ads, including optional rewarded videos. Ads are provided by third parties; we are not responsible for their content or for products they advertise.
5. Changes and availability
We may update, change or discontinue the Game or any feature at any time. Updates may be required to keep playing. We may update these terms; the effective date above will change, and continuing to play means you accept the updated terms.
6. Disclaimers
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Game will be uninterrupted or error-free.
7. Limitation of liability
To the fullest extent permitted by law, Northsight will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, progress or in-game items. Our total liability for any claim relating to the Game is limited to the greater of the amount you paid us in the 12 months before the claim or CAD $10. Nothing in these terms limits rights you have under consumer-protection law that cannot be waived.
8. Termination
You may stop using the Game at any time by deleting it. We may suspend or end your licence if you breach these terms.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
10. Apple and Google
If you downloaded the Game from the Apple App Store: these terms are between you and Northsight only, not Apple. Apple has no obligation to provide maintenance or support for the Game. If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation. Apple is not responsible for any claims relating to the Game, including product-liability claims, claims that it fails to meet legal or regulatory requirements, consumer-protection claims, or third-party intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. government embargo or listed as a prohibited party. You must also comply with Apple's Licensed Application End User License Agreement and any other applicable third-party terms. If you downloaded the Game from Google Play, the Google Play Terms of Service also apply.
